Not at all.  There are very good reasons to return 5xx after the DATA.
If by some miracle, you accidentally reject valid mail, at least the sender
receives a non-delivery notification.  On the other hand, if it really
*was* spam, at least you're not responsible for generating a bounce.

You're being a good Internet citizen by triggering a NDN, but you're being
a cautious Internet citizen by forcing someone else to generate the NDN.
