IIRC you have to demonstrate an actual connection -- i.e. that the
company being spamvertized hired the spammer.
As Ole Craig pointed out, simply declaring the company responsible for
any spam promoting it would open the door to massive abuse. Joe Jobs
are bad enough when all they do is damage a company's reputation (and
flood their servers/abuse desk). Imagine being able to legally make
someone else criminally liable for your own actions.
