I think the reason is obvious.  They are going to use the courts to go 
after the spammers who use this technique to bypass the filters in much 
the same way that Habeus is suing those that violate their copyright.



Spam isn't speech, just like a note wrapped around
a brick thrown through a window isn't publication.
