Not if your setup has checked and rejected mail that fails SPF and DomainKeys.  In that case, the mail that gets through is not forged.  All receiving MTAs should be performing these checks.

If a sender's mailbox is not protected by either of these, that's HIS problem - as sending your NDR would be the correct action under the standards.
