That's a perfect example that proves my point.

spammer.com can never claim that they were joe-jobbed.

I imagine conversations going like this...

Blacklist owner: You're blacklisted because of this spam.
Spammer: I didn't send that.  I don't even use that server.
Blacklist owner: Really?  Your SPF record says you do.
Spammer: Ah, well, er, um...
